Synergy of Economic Law and Cultural Protection in Optimizing the Local Creative Economy in Baubau City

Abstract

Culture-based creative economy serves as one of the strategic instruments for sustainable regional economic development. The City of Baubau possesses creative economic potential derived from the rich cultural heritage of the Buton community; however, its utilization remains suboptimal due to weak synergy between economic law and cultural protection. This research aims to analyze the framework of economic law and cultural protection, as well as formulate an integrative legal synergy model for the development of local creative economy in Baubau City. The research method employed is normative-empirical legal research (socio-legal research) with a statutory, conceptual, and empirical approach. Data was obtained through library studies and interviews with relevant stakeholders. The research findings indicate that, although there is vertical alignment between national and regional regulations, significant weaknesses persist in horizontal synchronization among agencies, the absence of specific regional regulations on creative economy, the lack of establishment of Regional Cultural Policy Guidelines (PPKD), and inadequate protection of communal intellectual property rights. This study proposes a model of synergy between economic law and cultural protection based on the principles of integration, sustainability, justice, participation, and tradition-based innovation to optimize the local creative economy in a sustainable and equitable manner.
